Terms of Service

The agreement that governs your use of yourgov.com.au

1. Acceptance of these Terms

By accessing or using yourgov.com.au (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

YourGov.com.au is operated by Trackita Pty Ltd (“YourGov”, “we”, “us”), an independent Australian organisation. We are not affiliated with, endorsed by, or representing any Australian government entity.

2. About the Service

YourGov.com.au publishes independent intelligence on the performance of Australian federal, state, territory and local government entities. The Service includes:

  • Department and agency scorecards built from publicly available data
  • Citizen surveys and the analysis of survey responses
  • Monthly intelligence reports on themed topics
  • Article-style commentary and trend analysis
  • Optional email subscriptions (weekly digest, survey results)
  • Optional 30-minute consulting bookings via Microsoft Bookings
3. Editorial Independence

We are not affiliated with any government department or political party. The opinions, scores, and analysis presented on the Service are those of YourGov and the citizens who participate in our surveys.

Department names, logos, and other identifying information are used solely for editorial reference and remain the property of their respective owners.

4. Accounts and Sign-In

Some features of the Service require you to sign in. We use Amazon Cognito as our identity provider, with optional sign-in via Google, Microsoft, or LinkedIn. You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account.

You agree to provide accurate information when signing up and to update it when it changes. We may suspend or terminate accounts that we reasonably believe are being used to abuse the Service or violate these Terms.

5. Acceptable Use

When using the Service, you must not:

  • Submit fraudulent, misleading, defamatory, or unlawful survey responses
  • Attempt to circumvent rate limits, scrape large volumes of data, or interfere with the Service's normal operation
  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Use the Service to harass any individual, group, government employee, or other user
  • Use automated tools (bots, scrapers, scripts) to submit survey responses or sign-ups
  • Use the Service in any way that violates Australian law

We reserve the right to remove content, suspend accounts, or block IP addresses that violate this clause.

6. Survey Submissions

By submitting a survey response, you grant YourGov a perpetual, royalty-free, worldwide licence to use, aggregate, analyse, and publish your response in our reports — in anonymised, aggregated form unless you explicitly consent to attribution.

We will never publish your email address, name, or other personally identifying information without your explicit consent. Free-text responses may be quoted in reports but will be anonymised by default.

7. Email Communications

If you subscribe to our weekly digest, survey-result notifications, or report announcements, we will send you those emails using SendGrid. Every email contains an unsubscribe link. You can unsubscribe at any time and we will remove your email from our marketing lists within 7 days.

We will not sell, rent, or share your email address with third parties for marketing purposes.

8. Consultation Bookings

The Service offers optional 30-minute consultation bookings, fulfilled through Microsoft Bookings. By booking a meeting, you agree to receive a calendar invite at the email address you provide. Meetings are subject to availability and may be rescheduled or declined at our discretion.

9. Intellectual Property

All original content on the Service — including reports, analysis, scorecards, articles, code, and design — is the property of YourGov / Trackita Pty Ltd and is protected by Australian and international copyright laws.

You may share, quote, and link to our content for non-commercial purposes provided you attribute YourGov.com.au and link back to the original source. Bulk republication, scraping, or re-hosting of our content requires written permission.

Australian government data referenced in our reports remains the property of its publisher and is used under the relevant Creative Commons or open-data licence.

10. No Warranties; “As Is”

The Service is provided “as is” without warranties of any kind, express or implied. We do our best to keep our reports accurate and up to date, but we do not warrant that:

  • The Service will be uninterrupted or error-free
  • Department scorecards or sentiment scores are perfectly accurate
  • The Service is fit for any particular purpose, including financial, legal, or policy decisions

Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, YourGov is not liable for any indirect, incidental, consequential, or special damages arising from your use of the Service. Our total liability to you for any claim arising out of these Terms or the Service is limited to AUD $100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

12. Third-Party Services

The Service uses third-party services including Amazon Web Services, SendGrid, Microsoft Bookings, and Google Analytics. Your use of those services through our Service is subject to their respective terms and privacy policies.

We may link to third-party websites for editorial reference. We are not responsible for the content, terms, or practices of those sites.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If the change is material, we will notify subscribers by email at least 14 days before the change takes effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Termination

You can stop using the Service at any time. To delete your account, email us at hello@yourgov.com.au.

We may suspend or terminate your access to the Service if you breach these Terms or if we cease operating the Service. We will give you reasonable notice where practicable.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising out of these Terms.
